Overview
These Terms of Service (“Terms”) govern your use of www.dezzavue.com and your purchase of products from Dezza Vue (“Dezza Vue,” “we,” “us,” or “our”). Shopify provides the ecommerce platform that enables us to offer the website and related services (“Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional policies displayed on the website—including our Returns, Exchanges & Product Issues Policy and Shipping Policy—form part of these Terms.
Eligibility and accounts
You must be at least the age of majority where you live, or use the Services with the permission and supervision of a parent or legal guardian. You agree to provide accurate, current information and to safeguard your account credentials. You are responsible for activity conducted through your account except to the extent caused by our failure to use reasonable security measures.
Products and descriptions
We try to describe and photograph our jewelry accurately. Screen settings, lighting, handmade or production variations, gemstone characteristics, and measurement methods may cause reasonable differences in color or appearance.
Product pages identify the materials and finishes represented to us, such as base metal, sterling silver, gold plating, vermeil, and gemstone type. “Gold over,” “gold-plated,” and “vermeil” do not mean solid gold. “Moissanite” does not mean diamond. Carat or carat-equivalent descriptions will be identified as accurately as reasonably possible.
Availability, descriptions, and prices may change before an order is accepted. Nothing in this section permits us to substitute a materially different product without your agreement or limits remedies for a defective or materially misdescribed product.
Jewelry may contain small components and is not intended for young children. Customers with metal sensitivities should review product materials before purchase. Unless expressly stated and adequately supported on a product page, we do not promise that a product is hypoallergenic, waterproof, tarnish-proof, or suitable for continuous wear.
Orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean we have accepted the order. We may refuse or cancel an order for legitimate reasons, including suspected fraud, pricing or inventory errors, payment problems, purchase limits, or legal restrictions.
If we cancel an order after payment, we will refund the canceled amount to the original payment method. We will contact you using the information supplied with the order when reasonably possible.
Prices, payments, and taxes
Prices are shown in the currency indicated on the website. Applicable shipping charges, taxes, duties, and other charges will be disclosed at checkout when they can be calculated. You represent that you are authorized to use the payment method submitted.
Promotional offers may have separate terms. If promotion terms conflict with these Terms, the promotion terms control for that promotion. We may correct genuine pricing or listing errors before accepting an order; if an affected order has already been charged and is canceled, we will issue a refund.
Shipping and delivery
Processing times, delivery estimates, international charges, address issues, damaged shipments, and lost-package procedures are described in our Shipping Policy. Delivery estimates are not guarantees unless we expressly state otherwise.
If we cannot ship within the promised timeframe, we will provide the notice, cancellation opportunity, and refund required by applicable law.
Returns, exchanges, and product issues
Returns, exclusions, refunds, product issues, and our exchange procedure are governed by our Returns, Exchanges & Product Issues Policy. Nothing in that policy or these Terms limits non-waivable rights or remedies under applicable consumer law.
Intellectual property
The Services and their original text, graphics, logos, photographs, videos, designs, and arrangement are owned by or licensed to Dezza Vue and are protected by applicable intellectual-property laws. You may use the Services only for personal, noncommercial shopping purposes.
You may not copy, reproduce, distribute, modify, sell, exploit, scrape, or use our content or trademarks without permission, except where applicable law allows it. Third-party names and marks belong to their respective owners.
Customer content and reviews
If you voluntarily submit a review, photograph, comment, or other content (“Customer Content”), you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights.
You grant Dezza Vue a nonexclusive, worldwide, royalty-free license to host, reproduce, display, and use Customer Content to operate and promote the Services. This license ends when the content is deleted from our systems, except for copies already lawfully used or retained for legal and operational purposes.
We may moderate Customer Content for lawful reasons, but we will not prohibit or penalize an honest review merely because it is negative. Any incentive connected to a review or endorsement must be clearly disclosed.
Prohibited conduct
You may not use the Services to violate law or another person’s rights; transmit malicious code; interfere with security or operation; engage in fraud; collect personal information unlawfully; impersonate another person; send unauthorized commercial messages; or access the Services through automated means in a manner that harms the Services or violates applicable law.
Third-party services and links
The Services may contain links or integrations operated by third parties. Their terms and privacy practices govern your use of those services. We are not responsible for third-party content or conduct, but this does not limit responsibility that applicable law places on us.
Shopify
Shopify provides the ecommerce platform supporting the Services. Purchases from this store are transactions between you and Dezza Vue, not Shopify. Shopify processes certain information as explained in our Privacy Policy and Shopify’s consumer privacy policy.
Privacy
Our collection, use, and disclosure of personal information are described in our Privacy Policy, available at https://www.dezzavue.com/policies/privacy-policy. Privacy requests may be submitted through the methods identified there.
Disclaimers
To the fullest extent permitted by law, the website and its general informational content are provided on an “as available” basis. We do not promise uninterrupted or error-free website operation.
Product warranties and remedies are governed by product-specific representations, our policies, and applicable law. We do not exclude or limit any warranty, consumer right, or remedy that cannot legally be excluded or limited.
Limitation of liability
To the fullest extent permitted by law, Dezza Vue will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the Services.
This limitation does not apply where prohibited by law, including liability that cannot lawfully be excluded for personal injury, fraud, willful misconduct, gross negligence, defective products, breach of non-waivable consumer rights, or violation of applicable privacy law.
To the fullest extent permitted by law, our aggregate liability for a claim concerning a particular purchase will not exceed the amount paid for that purchase. Some jurisdictions do not allow certain exclusions or limitations, so some of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to indemnify Dezza Vue against third-party claims resulting from your unlawful misuse of the Services, your violation of another person’s rights, or Customer Content you submit. This section does not require you to indemnify us for our own negligence, misconduct, legal violations, or defective products.
Changes to the Services or Terms
We may update the Services and these Terms prospectively. The version in effect when we accept an order generally governs that purchase. We will provide notice of material changes when required by law. Changes do not retroactively reduce rights that have already accrued.
Suspension and termination
We may suspend or terminate access for conduct that violates these Terms, threatens the security or integrity of the Services, or exposes us or others to legal risk. Provisions that by their nature should survive termination—including intellectual-property, liability, and dispute provisions—will survive.
Governing law and venue
These Terms are governed by the laws of the State of Washington and applicable federal law, without regard to conflict-of-laws principles. Subject to any non-waivable consumer right to bring a claim elsewhere, disputes may be brought in a court with jurisdiction in Washington.
We do not require binding arbitration under these Terms. Either party may use an eligible small-claims court.
Severability and waiver
If a provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms and the policies incorporated here are the complete agreement concerning the Services, except for any additional written terms agreed by the parties.
